TechFlow, July 24 — According to Cointelegraph, U.S. District Judge Jessica Clarke has denied the motion to dismiss filed by brothers Anton and James Peraire-Bueno, ruling that their act of stealing $25 million in cryptocurrency by manipulating Ethereum network MEV bots constitutes wire fraud. The MIT graduate siblings executed this unprecedented exploit in just 12 seconds using a four-step "bait, block, search, and spread" plan, deploying 16 Ethereum validators to carry it out. Although the brothers argued their actions complied with the system's code rules, the judge found that the government sufficiently alleged conduct meeting the criteria for fraud. The case is currently in the pre-trial motions phase, with trial scheduled for October 2025.
