TechFlow, July 24 — According to The Block, on July 23, the Ninth Circuit Court of Appeals issued a significant ruling in the long-standing legal dispute between Yuga Labs (creator of Bored Ape Yacht Club) and artist Ryder Ripps. The court determined that NFTs qualify as "goods" under the Lanham Act and are therefore eligible for trademark protection, setting a legal precedent for NFTs.
While the court rejected multiple legal arguments raised by Ripps, it also overturned the previous $9 million penalty and sales injunction against him, remanding the case to the lower court for reconsideration to determine whether an ordinary NFT buyer could be confused about the legitimacy of Ripps' replicated works.
