TechFlow, April 23 — According to Jinshi Data, U.S. President Trump is seeking to direct legal challenges against his broad tariff policy to the Court of International Trade (CIT), a specialized court that handles tariff disputes. While this strategy did not yield immediate success during his first term, it ultimately delivered favorable outcomes.
The Trump administration is moving to transfer three lawsuits currently pending in federal courts in Florida, Montana, and California to the Court of International Trade. Legal experts suggest that channeling these cases through this judicial route could benefit the government, as any appeals would go to the Federal Circuit Court of Appeals, which has historically shown deference to presidential authority on tariff imposition. "The Court of International Trade has issued rulings against the government in several cases," said Warren Maruyama, former general counsel at the Office of the U.S. Trade Representative, "but most of those decisions were overturned upon appeal to the Federal Circuit."
