Under the terms, investors must waive their right to initiate class-action lawsuits against any protected party; violators will be responsible for associated legal fees and litigation costs. This provision does not affect an investor’s right to pursue individual arbitration, and investors may opt out of this dispute resolution clause by providing written notice within 30 days of first visiting the website.
"To the fullest extent permitted by law, you agree that you will not commence, join, or participate in any class action lawsuit against any protected party regarding any claim, dispute, or controversy. You agree to the issuance of injunctive relief to halt such litigation or remove you as a participant. You agree to pay the attorneys’ fees and litigation expenses incurred by any protected party in seeking such relief.
This provision preventing you from commencing, joining, or participating in a class action: (i) does not constitute a waiver of any rights or remedies you may have to bring claims individually (and not as part of a class action) through the binding arbitration process described above; and (ii) constitutes a separate agreement. You may opt out of these dispute resolution terms by providing written notice within thirty (30) days of your first visit to the website."
