The main challenge for cryptocurrency regulation—especially in the United States—has consistently been this phenomenon: if you do something useless, or ask people for money in exchange for vague references to potential returns, you remain free and innocent. But if you try to clearly explain to your customers where returns come from and promise them specific rights, then you're doomed, because you've become a "security." The incentive structure created by this "tyranny of lawlessness" ultimately ends up worse than either pure anarchy or pure tyranny.
