TechFlow news, the Siming District People's Court of Xiamen City, Fujian Province published an article titled "Recognition of Virtual Currency's Property Attributes and Handling of Involved Assets" in the People's Court Daily. The article analyzes the criminal law attributes of virtual currency, stating that virtual currency possesses economic characteristics and can be classified as property. Current laws and policies do not define virtual currency as illegal items; therefore, under the existing legal and policy framework, virtual currency held by relevant entities in China remains lawful property protected by law.
The article recommends handling involved assets based on their legality. The author believes that in cases involving virtual currency-related crimes, involved assets should not uniformly be confiscated or returned. Instead, they should be treated differently, ensuring balanced protection of individual property rights and societal public interests within a unified framework of criminal and civil legal order.
