TechFlow reported, according to Blockworks, that Ripple Labs' attorneys sent a letter to Judge Analisa Torres stating their opposition to the U.S. Securities and Exchange Commission's (SEC) recent move seeking an interlocutory appeal of the summary judgment order last week. The attorneys stated: "Having failed to meet its burden of providing facts supporting the application of Howey to all distributed digital assets XRP, the SEC has now done a complete turnaround, rushing to appeal what it claims is a pure 'question of law' that will impact all other digital asset cases."
Ripple Labs argued that the SEC does not meet the standards required to advance an interlocutory appeal, specifically asserting that the regulator lacks sufficient evidence to demonstrate a "substantial ground for difference of opinion."
