TechFlow news — According to Fortune, U.S. prosecutors on Monday submitted court filings disclosing some of the evidence they plan to use in the case against FTX founder Sam Bankman-Fried, including personal notes from his former girlfriend and former Alameda Research CEO Caroline Ellison.
Prosecutors intend to use Ellison’s notes and to-do lists to demonstrate that Bankman-Fried illegally used FTX customer funds to cover Alameda’s asset shortfall.
They also plan to use documents from two other co-conspirators who are cooperating with prosecutors: Nishad Singh, FTX’s former head of engineering, and Gary Wang, a co-founder of FTX.
Prosecutors also possess a recording of Ellison’s November 9 employee meeting, during which she admitted that Alameda had "borrowed" substantial funds from FTX.
Although reports indicate another executive, Ryan Salame, is seeking a plea deal, prosecutors stated he will invoke the Fifth Amendment and decline to testify at trial.
Bankman-Fried’s legal team has objected to the delayed disclosure of evidence by prosecutors, arguing it hampers their defense preparation.
