Krohn argues that the SEC incorrectly applied securities laws, maintaining that the company sold high-performance computing hardware, not securities. Previous report, Judge Ann Marie McIff Allen of the Utah District Court denied the defendants' motion to dismiss, finding the SEC's allegations of unregistered securities sales to be "well-supported by evidence."
