It’s simply prolonging a situation that has already thoroughly embarrassed the agency. The court has already rejected the SEC’s claim of reckless conduct by Ripple, there are no fraud allegations in the case, and certainly no victims or losses.
Under current Chair Gary Gensler, the SEC has failed to faithfully execute the law and continues its litigation campaign against the crypto industry. We are evaluating whether to file counterclaims. Regardless, the SEC’s lawsuit was irrational and misleading from the start, and we are ready to prove this again in the appellate court (once again leading the way for the industry)."
