TechFlow reports that U.S. District Judge Jia Cobb for the District of Columbia has issued a formal opinion ruling that the Commodity Futures Trading Commission (CFTC) does not have the authority to conduct a "public interest review" to block Kalshi from launching political prediction markets in the United States.
Judge Cobb stated that, unless involving specific areas such as terrorism or gambling, Congress has stripped the CFTC of its power to conduct public reviews of certain proposed futures contracts.
The judge concluded that Kalshi's contracts do not involve illegal activities or gambling but instead pertain to elections—matters outside the CFTC's jurisdiction.
