TechFlow reports that law firm Pomerantz LLP has announced the filing of a class action lawsuit against Applied Digital Corporation, a computing data center colocation services provider, and certain of its officers and directors.
Specifically, the defendants are alleged to have made false and/or misleading statements and/or failed to disclose that: (i) Applied Digital overstated the profitability of its data center colocation business and its ability to successfully transition into a low-cost artificial intelligence cloud services provider; (ii) the Applied Digital board of directors lacked independence as defined by Nasdaq listing rules; (iii) as a result, Applied Digital overstated the effectiveness of its business model and failed to maintain proper corporate governance standards; and (iv) such undisclosed issues, once revealed, could subject the company to significant financial and/or reputational harm.
