TechFlow reported on October 23 that, according to Bloomberg, Commodity Futures Trading Commission (CFTC) Chairman Rostin Behnam stated the CFTC is now at a "crossroads" following a court ruling legalizing contracts allowing speculators to bet on the outcome of presidential elections. Although the CFTC has appealed the decision and maintains that such enforcement falls outside its jurisdiction, the agency still plans to comply with the court's ruling and regulate trading in these derivative contracts.
Behnam emphasized that these types of contracts are expected to continue growing, requiring the CFTC to closely monitor their development. He also noted that the ruling exacerbates existing resource constraints as the CFTC grapples with an influx of assets, including cryptocurrencies. Meanwhile, Behnam recently urged Congress to take action during the SIFMA annual conference, calling for legislation on both cryptocurrency regulation and election-based gambling.
