This approach would significantly increase potential penalties for violations of content moderation rules. Under the EU’s Digital Services Act, online platforms can be fined up to 6% of their global annual revenue if they fail to address illegal content and disinformation or comply with transparency requirements. Regulators are considering whether, in determining potential fines against X, they should include sales not only from the social network but also from SpaceX, Neuralink, xAI, and The Boring Company. One insider indicated that Tesla’s revenue would not be included in this calculation, as it is a publicly traded company not fully controlled by Musk. The potential fine amount is still under discussion. X may avoid penalties if it finds ways to address the regulators’ concerns.
